Starbucks and Union Entangled in Legal Dispute over Pro-Palestinian Post

Starbucks, the largest coffee retailer globally, and Workers United, the union representing its employees, are currently engaged in a legal confrontation stemming from a pro-Palestinian social media post issued by the union amid the Israel-Hamas conflict in May 2021.

The contentious post, which was removed after only 40 minutes, featured a Starbucks cup emblazoned with "Solidarity with Palestine" alongside the union's emblem. It also used Starbucks' name and its trademark green siren logo without authorization.

Starbucks contends that the post harmed its reputation and violated its trademark by utilizing its brand identity without consent. The company demanded that the union cease the use of its name and logo, along with compensation for damages incurred.

Workers United, however, refutes these claims, asserting that Starbucks has defamed the union by insinuating support for terrorism and violence. The union argues that as a representative of Starbucks workers, it holds the right to employ the company's name and logo.

On October 13, Starbucks sent a letter to Workers United insisting that they refrain from using its name and any similar imagery. In response, Workers United pointed out that its page on X clearly identifies it as a union entity.

"Starbucks is attempting to exploit the current tragedy in the Middle East to further its anti-union agenda," remarked Lynne Fox, president of Workers United, in her correspondence to Starbucks.

The lawsuit reflects a broader struggle between Starbucks and Workers United, which has been actively working to unionize Starbucks employees across various locations in the U.S. and Canada.

"This is not merely a trademark issue. It's about Starbucks trying to suppress a union that advocates for justice," stated Stuart Appelbaum, president of Workers United.

Michelle Flores, a union member and Starbucks employee, expressed, "Starbucks is attempting to intimidate us into submission, but we will persist in our fight for both workers' rights and human rights."

In the midst of this legal battle, Starbucks has been known for its support of various social causes, yet it appears to draw a line when it comes to the issue of Palestine. Some lawmakers, including Republican Senator Rick Scott from Florida, have called for boycotts against the coffee chain, with state Rep. Randy Fine tweeting on October 11, "If you go to Starbucks, you are supporting killing Jews."

Starbucks has expressed its sympathy for innocent individuals affected by the conflict in both Israel and Gaza.

The BDS movement advocates for the boycott of Israeli products and companies that endorse Israel's occupation of Palestinian territories.

"Starbucks unequivocally condemns acts of hate, terrorism, and violence," stated Sara Kelly, Executive Vice President of Starbucks, in a letter to employees last week.

While Workers United has not made a public statement, its parent organization, the SEIU, acknowledged on Tuesday that many of its members have family members affected by the conflict, asserting that "all Israelis and Palestinians deserve safety, freedom from violence, and the opportunity to thrive."

The ongoing legal battle between Starbucks and Workers United is likely to intensify as both parties strive to uphold their respective positions and interests. This case could also set a precedent for other unions and companies that utilize social media to express their perspectives on contentious issues.
